29 CFR 1910.28(b)(13)(iii)(A): When work is performed 15 feet (4.6 m) or more from the roof edge, the employer did not protect each employee from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system or a designated area. The employer is not required to provide any fall protection, provided the work is both infrequent and temporary. a) Facility: On or about September 16, 2022, employees performed frequent and regular maintenance and inspection duties on the roof, approximately 40 feet above grade, and the employer did not provide any means of fall protection. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
