29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii).  b) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii).  c) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv).  d) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v).  e) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii).  f) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not provide training on putting on, removing, or the limitations of the respirators for employees required to use the respirators as required in 1910.134(c)(1)(viii).  g) Global Harvest of Colorado, LLC, 101 West Railroad Ave. Akron , CO 80270: On or about September 16, 2022, and at time's prior,  employees were exposed to respiratory hazards when entering grain bins and boot pits. The employer did not establish work-site specific procedures to regularly evaluate the effectiveness of the program as required in 1910.134(c)(1)(ix).

29 CFR  1910.146(k)(1)(ii): When designating rescue and emergency services pursuant to paragraph (d)(9), the employer did not evaluate the prospective rescuer's ability, in terms of proficiency with rescue-related tasks and equipment, to function appropriately while rescuing entrants from the particular space or types of spaces identified:   a) 101 West Railroad Ave.; Akron, CO 80720: On or about September 16, 2022, and at times prior, employees were exposed to engulfment hazards while performing grain bin and boot pit cleaning operations. The employer failed to ensure that rescue equipment was available for rescue in a permit required confined space.

29 CFR  1910.146(k)(2): An employer whose employees have been designated to provide permit space rescue and emergency services did not take the measures in accordance with items i-iv of this sub-paragraph:  a) 101 West Railroad Ave.; Akron, CO 80720: On or about September 16, 2022, and at times prior, employees were exposed to engulfment hazards while performing grain bin and boot pit cleaning operations. The employer failed to ensure that employees were trained to provide rescue and emergency services.
