29 CFR 1910.134(c)(2): The employer did not develop and implement a respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:(Construction Reference 1926.103) a) At the Spirit Mountain Casino's hotel remodeling project, located at 27100 Salmon River Highway, Grand Ronde OR, on 09-16-2022, the employer failed to establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily while spray-painting knew how to clean, store and maintain pressure demand respirators so that its use does not present a health hazard to the user. b) At the Spirit Mountain Casino's hotel remodeling project, located at 27100 Salmon River Highway, Grand Ronde OR, on 09-16-2022, the employer failed to determine that respirator use will not in itself create a hazard by providing the employees using a respirator voluntary with the information contained in appendix D, including the appropriate respirator selection.
