29 CFR 1926.300(a): Condition of tools. All hand and power tools and similar equipment, whether furnished by the employer or the employee, were not maintained in a safe condition. On or about September 19, 2022, an employee operated a chop saw to cut bricks with the guard bypassed, exposing the employee to construction hazards such as but not limited to; being struck by materials or lacerations from the exposed blade.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. On or about September 19, 2022, an employee accessed and egressed a scaffold by means of climbing the sides of the scaffold which did not contain an approved point of access, exposing the employee to the hazards of falling from a scaffold approximately 10 feet from the ground.

29 CFR 1926.451(e)(4)(xii): Guardrails meeting the requirements of paragraph (g)(4) of this section were not provided on the open sides and ends of each landing. On or about September 19, 2022, and at times prior thereto, an employee was working from a scaffold without guardrails provided at the open sides and ends, exposing the employee to hazards such as falling approximately 12 feet.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces was not between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail crossing point of two braces were not between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The endpoints at each upright were more than 48 inches (1.3 m) apart. On or about September 19, 2022, and at times prior thereto, an employee was laying cement and bricks from a scaffold where midrails were not used. Crossbracing was between 38 inches and 48 inches, exposing the employee to a fall hazard of approximately 12 feet to the ground below.
