29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) On or about September 20, 2022, employees were observed during roofing construction on an existing two-story single-family residential roof located at 17108 Riverside Drive, Lakewood, Ohio 44107. The employer did not ensure employees were protected from the fall hazard of 11.2 feet by use of a guardrail systems, safety net system, or personal fall arrest system. The Davalos Construction and More, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1519241, citation number 1, item number 4 and was affirmed as a final order on 06-17-2021, with respect to a workplace located at 7564 Walnut Drive, Canal Winchester, Ohio 43110.
