29 CFR 1926.964(a)(2): Before allowing employees to subject elevated structures, such as poles or towers, to such stresses as climbing or the installation or removal of equipment may impose, the employer did not ascertain that the structures are capable of sustaining the additional or unbalanced stresses. If the pole or other structure cannot withstand the expected loads, the employer did not brace or otherwise support the pole or structure so as to prevent failure. a) Pole number 50/28, Neihart, MT: On or about September 17, 2022, employees were exposed to fall hazards of 35 feet to the ground below and struck by hazards in the event the wooden poles they were replacing were put under new stresses such as removing cross bracing that supported the structure. Although the employer evaluated the pole through a visual inspection and hammer test and developed a plan to support the pole, the employer failed to take additional steps to brace or otherwise support the pole or structure so as to prevent failure.
