29 CFR  1926.451(c)(2)(v):Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  a) Jose Bonilla Gozalez, at the jobsite located at 3839 Moors Edge Ln., Powell, Ohio 43065: On or about September 19, 2022, the employer permitted employees to work from a support scaffold platform of OSB sheathing that was not attached to the Gradall GTH-1056 rough terrain forklift (model: G534C-6; S/N: 0388367), thereby exposing the employees to fall hazards greater than 18 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Jose Bonilla Gonzalez, at the jobsite located at 3839 Moors Edge Ln., Powell, Ohio 43065: On or about September 19, 2022, the employer did not ensure fall protection was utilized by employees engaged in framing activities to a two-story residential house, thereby exposing the employee to fall hazards greater than 18 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Jose Bonilla Gozalez, at the jobsite located at 3839 Moors Edge Ln., Powell, Ohio 43065: On or about September 19, 2022, the employer failed to provide employees with a fall protection training program for the recognition of fall hazards and procedures to be followed to minimize these hazards, thereby exposing employees to fall hazards greater than 18 feet.
