The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired: On or about September 22,2022, at 3901 St. Lucie Blvd., Fort Pierce, Florida, walking-working surfaces in use included a damaged dock plate, thus creating tripping hazards and affecting the operation of powered industrial trucks (PIT).

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: On or about September 22,2022, at 3901 St. Lucie Blvd., Fort Pierce, Florida, powered industrial trucks (PIT) in use had significant sections of their rubber tires missing, thus affecting the forklift's stability and exposing employees to struck-by hazards.
