OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inhalation/suffocation hazards:  On or about September 19, 2022, at the Channing oil and gas waste treatment and disposal facility, employees were exposed to inhalation/suffocation hazard while working in areas with potential Hydrogen Sulfide (H2S) and using H2S monitors which were not properly calibrated and/or bump tested.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:  Channing oil and gas waste treatment and disposal facility: On or about September 21, 2022, the employer did not perform air monitoring along with a workplace assessment and/or job hazard analysis to determine if hazards were present or were likely to be present during removal of sludge water/oil by-products from the sump pit. This condition exposed employees to dangerous levels of hydrogen sulfide.
