Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level was protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii). On or about September 21, 2022, and at times prior there to, employees were working from a hydraulic lift without any means of fall protection and were exposed to falls greater than 4 feet to a lower level.
