29 CFR 1926.651(b)(1): The estimated location of utility installations, such as sewer, telephone, fuel, electric, water lines, or any other underground installations that reasonably may be expected to be encountered during excavation work, shall be determined prior to opening an excavation. a) Adjacent to the intersection of Loblolly Circle and Candy Harbor Way in the Arbor Lyn Development, Dewey Beach, DE 19971: On or about September 24, 2022, the employer did not ensure the estimated location of utility installations were determined prior to using power trenching equipment to install irrigation in a yard with electrical power conductors exposing employees to shock/electrocution hazards as well as gas line exposing employees to fire/explosion hazards.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement: a) Adjacent to the intersection of Loblolly Circle and Candy Harbor Way in the Arbor Lyn Development, Dewey Beach, DE 19971: On or about September 24, 2022, the employer did not install any type of protections to prevent the impalement hazards associated with the reinforcing steel protruding from the ground where employees consistently had to walk across to access the work area from their trailer. Employees continued to work crossing back and forth exposing them to the impalement hazards at the site.
