29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about September 24, 2022, the employees were exposed to a fall hazard while accessing the roof with a ladder whose side rails did not extend at least three feet above the landing surface: Instance #1- EE's were using the ladder (#1) on the eastside of the two-story house that was under construction to get themselves, their tools, and materials up and down from the roof. Instance #2- EE's were using the ladder (#2) on the southside of the two-story house that was under construction to get themselves, their tools, and materials up and down from the roof. Instance #3- EE's were using the ladder (#4) on the westside of the two-story house that was under construction to get themselves, their tools, and materials up and down from the roof.
