29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: Cushnoc Drive, Augusta, Maine - The employer did not ensure employees were protected against electric shock while using an excavator to load road materials into a dump truck parked directly below unguarded live electrical lines. The lowest power line was at a height of 29'5" and the excavator had a maximum reach of of 33'9". Contact with the line by the excavator would cause a short to ground through the excavator and potential arc flash.

29 CFR 1926.416(a)(3): Employer did not post or maintain proper warning signs at locations where the performance of the work could bring a person, tool, or machine into physical or electrical contact with an energized electrical power circuit. Cushnoc Drive, Augusta, Maine - The employer did not post or maintain proper warning signs at locations where the performance of work could bring employees or equipment into physical contact with unguarded electrical lines. There were no signs posted at the location warning the operator that contact with the line by the excavator would cause a short to ground through the excavator and potential arc flash. An excavator was loading road materials into a dump truck parked directly below unguarded live electrical lines.
