29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about September 26, 2022, employees were performing construction work activities from a roof without fall protection. This exposed the employees to a fall hazard greater than six (6) feet to the ground below.

29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section did not comply with the provisions listed in subparagraphs (i) through (xv) of this paragraph. On or about September 26, 2022, employees used a forklift mounted man basket to access the roof of a building and the man basket was missing a midrail on each side. This exposed the employees to a fall hazard greater than ten (10) feet to the ground below.
