29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) Employees utilizing pneumatic nail guns, hammers and circular saws are not being protected from eye injuries.  The employer fails to assure effective protection against struck by hazards as required by the standard, as demonstrated on September 24, 2022, 8920 N. Newport Ave Tampa, FL 33604, when three employees were exposed to eye injuries while operating pneumatic nail guns, hammers and portal circular saws during framing operations at, in that; eye protection was not used by the employees.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:   a. An employee framing is not protected from fall hazards by the use of a fall protection system.  The employer fails to assure effective protections against falls as required by the standard, as demonstrated on September 24, 2022, at 8920 N. Newport Ave Tampa, FL 33604, when an employee is framing the structure and is exposed to an approximate 11-foot and 15-foot fall hazard to the ground in that fall protection equipment is not installed or utilized.    To abate this violation, the employer must ensure that all employees wear appropriate fall protection when an employee works more than 6 feet above the next lower level.

The employer fails to assure effective protections against falls as required by the standard, as demonstrated on September 24, 2022, at 8920 N. Newport Ave Tampa, FL 33604, when an employee is installing roof sheeting and is exposed to an approximate 11-foot and 15-foot fall hazard to the ground in that fall protection equipment is not installed or utilized.    To abate this violation, the employer must ensure that all employees wear appropriate fall protection when an employee works more than 6 feet above the next lower level.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) At the job site, located at 8920 N. Newport Ave Tampa, FL 33604, on or about 9/24/22; the employer did not ensure that each employee exposed to fall hazards were trained and have a clear understanding of fall protection requirements during residential construction activities prior to the exposure.   DOMINGOS 54 CONSTRUCTION INC was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1538421, citation number 1, item number 1 and was affirmed as a final order on 1/19/22, with respect to a workplace located at 2504 W. Parkland Blvd Tampa, FL 33609.   DOMINGOS 54 CONSTRUCTION INC was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1530444, citation number 2, item number 2 and was affirmed as a final order on 10/1/21, with respect to a workplace located at 9251 -9255 Royal River Cir Parrish, FL 34219.   DOMINGOS 54 CONSTRUCTION INC was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1467585, citation number 1, item number 1 and was affirmed as a final order on 9/21/20, with respect to a workplace located at 10813 Applewood Range Way Tampa, FL 33647.
