29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets.  On or about September 26, 2022, and at times prior thereto, employees were installing shingles to a new home under construction without the use of hard hats while work was occurring directly above, exposing the employees to the hazard of being struck-by falling debris, tools and materials.

29 CFR 1926.102(a)(1): The employer did not  ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about September 26, 2022, employees used pneumatic nail guns to install shingles to the roof of a residential home under new construction without wearing eye protection, exposing the employees to the hazard of being struck in the eye(s) by flying debris or projectiles.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented.  On or about September 26, 2022, employees were installing shingles to a residential home under new construction without the use of a fall protection system, exposing the employees to a hazard of falling approximately twenty feet to the ground.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access.  On or about September 26, 2022, employees accessed the roof of a one-story home by using a portable ladder that was not extended at least 3 feet above the upper landing surface, exposing employees to a fall hazard of approximately 10 feet to the ground below.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record did not contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record did not indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about September 26, 2022, and at times prior thereto, the employer did not prepare a written certification verifying that employees had been trained in hazards related to falls from elevation.
