29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) On or about August 24, 2022, at a new residential construction site located at 459 Brandon Drive, Bismarck, ND, employees working in close proximity to someone operating pneumatic nail guns were exposed to eye and face hazards from flying particles while working on a residential roof without wearing impact resistant eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  (a) On or about August 24, 2022, at a new residential construction site located at 459 Brandon Drive, Bismarck, ND, where employees were engaged in roofing activities, the employees were exposed to fall hazards greater than 6 feet without a fall protection system in place.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:  a) On or about August 24, 2022, at a residential construction site located at 459 Brandon Drive in Bismarck, ND, employees were allowed to continually use a ladder that did not extend three or more feet above the landing surface while installing roofing shingles.
