29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Tire Warehouse Bins : On September 28, 2022 and at times prior to; Hyster R30XMS2 order picker operators unclipped from their PFAS to move tires into position on elevated product pallets up to 14.6 feet in height. Employees are elevated to heights up to 14.6 feet on industrial composite tire pallets supported by the forks of industrial pickers. Employees are using composite pallets as working platforms. Note* Abatement certification and documentation are required for this item.

Lanyard length did not allow for employees to move between tire racks to select tires for customer orders, and a procedure for installing and reinstalling the lanyard in order to move between bins had not been adequately implemented. Employees have not been adequately trained to connect and disconnect between tire bins. Note* Abatement certification AND documentation are required for this item.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards while storing and retrieving tires from an industrial rack system that had damage, was not secured to the floor or formally inspected periodically: a) Bin 6: On September 29, 2022, and times prior, components of the rack system, used for the storage of tires, were damaged. This damage included but may not be limited to a bent support member on the right side of the rack. b) Bin 6: On September 29, 2022, and times prior, the support columns of the right side of the rack system, used for the storage of tires, was missing a screw in the base plate. c) On September 29, 2022, and times prior, comprehensive, periodic inspections were not being conducted on the rack system in the warehouse. Note* Certification of corrective actions is required for this items.
