Location: 600 Governors Drive, Winthrop, MA  On or about 09/30/22, an employee was witnessed reentering the basket of the JLG aerial lift by climbing over the railing of a third story balcony.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  Location: 600 Governors Drive, Winthrop, MA  On or about 09/30/22, an employee was exposed to a fall hazard from a third story balcony as he climbed the railing of the balcony to reenter the basket of a JLG aerial lift without fall protection on or in place to protect the employee from falling to a lower level.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.  Location: 600 Governors Drive, Winthrop, MA  On or about 09/30/22, an employee working from an aerial lift was not protected from ejection hazards where personal fall restraint equipment was not worn or connected to the basket of the lift.
