29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired. On or about October 3, 2022, employees utilized a damaged extension ladder for access and egress. The employer did not ensure the damaged ladder was tagged and removed from use. Employees were potentially exposed to a fall hazard.

29 CFR 1926.251(b)(1): Welded alloy steel chain slings shall have permanently affixed durable identification stating size, grade, rated capacity, and sling manufacturer. On or about October, 3 2022, employees utilized alloy chains to lift and place equipment into the excavation that were not equipped with a tag. The employer did not ensure chains were equipped with a tag stating size, grade, rated capacity, and sling manufacturer prior to employee use. Employees were potentially exposed to struck-by hazards.
