29 CFR  1903.19(c)(1):Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  As of February 13, 2023, the employer had not certified to OSHA within 10 calendar days that abatement was completed for the violation Citation1 Item 1a, Citation 1 Item 1b, Citation 1 Item 2, Citation 1 Item 3, from Inspection number 1625921, issued on November30, 2022  with a final order date of February 1, 2023.

As of February 13, 2023  , the employer had not submitted to the Agency documents that abatement had been completed for any serious violations indicated by the Agency included in Citation1 Item 1a  from inspection 1625921, issued November 30, 2022 , with a final order date of  February 1, 2023.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  16 Adsit Crosby Rd., New Marlboro, MA: On or about October 3, 2022, 2 employees were observed working on a residential structure engaged in roofing activities with unprotected sides and edges greater than 19 feet above the next lower level  and were not protected by either guard rails, safety net systems or personal fall arrest systems exposing them to fall from height hazards.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).
