29 CFR  1926.416(e)(1):Worn or frayed electric cords or cables shall not be used.  The employer is failing to protect employees from electrocution hazards.   This was most recently documented on or about October 4th, 2022, at 21010 Joseph Street, Elkhorn, Nebraska 68022.  Employees were using frayed electric cords to power their tools while conducting framing operations.   Vargas Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.416(e)(1), which was contained in OSHA inspection number 1604933, citation number 2, item number 1and was affirmed as a final order on 10-3-22, with respect to a workplace located at 19254 Ruggles Circle, Elkhorn, Nebraska 68022.

The employer is failing to protect employees from fall hazards.  This was most recently documented on or about October 4th, 2022, at 21010 Joseph Street, Elkhorn, Nebraska 68022.  Employees were observed conducting framing operations on a residential structure at heights greater than 6 feet and they were not protected by guardrails, safety net system, or a personal fall arrest system.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  Employees engaged in residential construction activities at 21010 Joseph Street, Elkhorn, Nebraska 68022,  were exposed to fall hazards in that they were working at heights greater than 6 feet without any fall protection.  The employer indicated that he has provided his employees with fall protection training, however, the employer indicated that he does not have  written certification that his employees have been trained.
