29 CFR 1926.451(a)(6):Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. On or about October 04, 2022, at the previously addressed job site, an employee was observed working from a JLG Skytrak telehandler, with a scaffold platform raised in the air on the forklifts tines of the JLG Skytrak and was used to lift an employee above 15 feet into the air to perform window installation operations creating exposure to fall hazards.

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. On or about October 4, 2022, at the previously addressed job site, an employee was observed working from a JLG Skytrak telehandler with work scaffold suspended from the fork tines raised to a height of over 15 feet in the air was exposed to fall hazards as the employee was not wearing any fall protection and no railings were present on the scaffold to prevent a potential fall.
