29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  a) On or about October 4, 2022, at the previously addressed inspection site, the employer, while acting as the competent person was not conducting frequent and regular inspections of the job site to ensure fall protection was being utilized and that job site conditions were maintained safe.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  a) On or about October 4, 2022, at the previously addressed inspection site, employees were performing a roof tear off in preparation to reroof a residential duplex building while unprotected from falls of greater than six feet to the lower levels.  There is no abatement certification or documentation required for this item. The hazard was corrected during the inspection.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about October 4, 2022, at the previously addressed inspection site, the employer did not provide a training program for employees exposed to falls when performing a roof tear off in preparation to reroof a residential duplex building.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
