29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:   On or about October 05, 2022, at a commercial construction site located at 6786 - 6788 Pearl Road Cleveland, Ohio 44130, the employer did not ensure inspections of excavations, the adjacent areas, and protective systems were made by a competent person exposing an employee working in a nine foot deep trench to a possible cave-in.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):   On or about October 05, 2022, the employer did not ensure employees engaged in pipe work in a 09 foot deep trench on a commercial construction site located at 6786 - 6788 Pearl Road Cleveland, Ohio 44130, were protected from cave-ins by a protective system.
