29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used. On or about October 6, 2022, and at times prior thereto, employees were climbing the framing of the scaffolding to access the working surface, exposing the employees to a fall hazard.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200-pound top rail capacity). On or about October 6, 2022, and at times prior thereto, employees used a tubular-welded frame scaffold to lay brick without the use of fall protections, exposing the employees to the hazard or falling approximately 10 feet.
