29 CFR  1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about October 3, 2022 and times prior there to, employees working from pump jack style scaffolding systems, that measured more than 10 feet above the lower level, were not protected from falling hazards by the use of personal fall arrest systems at the following instances:  a) Pump jack scaffolding on the Northern side of the home facing Unity Drive b) Pump jack scaffolding on the Southern side of the home facing Long Road

29 CFR  1926.454(a):The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedures to control or minimize those hazards.   On or about October 3, 2022 and times prior there to, employees working from scaffolding systems at a height greater than ten feet in the air had not been trained by a competent person to recognize and minimize fall hazards associated with the work being performed.
