29 CFR  1926.451(b)(1):29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports:  On or about October 3, 2022, employees were exposed to a fall of approximately 20 feet while performing masonry activities on a residential home located at 1123 Bean Lane, Akron, Ohio 44313. The employees were working on upper levels of the platform and the employer did not ensure that the platform was fully planked with no more than a one-inch gap.

29 CFR  1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph.   On or about October 3, 2022, employees were exposed to a fall of approximately 20 feet while performing masonry activities on a residential home located at 1123 Bean Lane, Akron, Ohio 44313. The base of the platform was 5 feet wide; the employees were working on a platform that was 20 feet high and the employer did not ensure that it was restrained from tipping.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:   On or about October 3, 2022, employees were exposed to a fall of approximately 20 feet while performing masonry activities on a residential home located at 1123 Bean Lane, Akron, Ohio 44313. The employees were working on the upper platform of the scaffold and the employer did not ensure a competent person had conducted an inspection before the work started.

Employees were working on the upper platform of the scaffold, above a ground employee, and the employer did not ensure the ground employee was protected from falling materials.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.   On or about October 3, 2022, employees were exposed to a fall of approximately 20 feet while performing masonry activities on a residential home located at 1123 Bean Lane, Akron, Ohio 44313. The employees were working on the upper platform of the scaffold and the employer did not ensure there was a safe access point.  JLS Masonry LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 1325240, citation number 1, item number 2, and was affirmed as a final order on (7/31/18), with respect to a workplace located at 36425 Capri Lane, North Ridgeville, Ohio 44039.

The employees were working on the upper platform of the scaffold and the employer did not ensure they were using fall protection.
