1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. The Director of the Federal Register approves this incorporation by reference in accordance with 5 U.S.C. 552(a) and 1 CFR part 51. (a) Jobsite, I 376 Eastbound under the Oakland offramp in Pittsburgh, Pennsylvania: On or about October 7, 2022 at approximately 3:00 am, an aerial lift bucket extended over an open traffic lane and the area below the bucket was not closed to traffic and properly barricaded to protect workers. The bucket was struck by a tractor trailer driving through the open traffic lane, resulting in fatal injuries to the employee working from the elevated bucket stringing steel cables.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees were exposed to struck-by hazards caused by inadequate lighting conditions during nighttime highway construction work: (a) Jobsite, I 376 Eastbound under the Oakland offramp in Pittsburgh, Pennsylvania: On or about October 7, 2022 at approximately 3:00 am, the jobsite was not adequately lighted throughout the entire work area, nor did the company have a lighting plan for the work area.
