29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) 346 Mantoloking Road, Brick NJ: Workers engaged in roofing and other related activities were exposed to fall hazards, up to and more than 20 feet to the ground surface below, when walking on and working on a roof of a residential structure without the use of fall protection. Condition noted on or about 10/07/2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) 346 Mantoloking Road, Brick NJ: Workers engaged in roofing and other related activities were exposed to fall hazards, up to and more than 10 feet to the ground surface below, when using ladders that were not properly set up and not extended at least 3 feet to gain access to working surface. One ladder rail was on the siding and the other rail was roughly 10 inches above the landing surface (ladder was setup on and angle near the corner of the house). Condition noted on or about 10/07/2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(15): Ladder was not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  (a) 346 Mantoloking Road, Brick NJ: Workers engaged in roofing and other related activities were exposed to a defective ladder that had severely bent rungs, that was being used up to and more than 10 feet above the ground level. Condition noted on or about 10/07/2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
