29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) On or about 10/11/2022, in Buildings 1 and 2; employees were exposed to struck by hazards when the employer did not ensure a formal Powered Industrial Vehicle (PIV) Training Program was in place and provided to new employees operating PIVs. Employees operated PIVs such as, but not limited to; Clark WPX-45 pallet jack (Serial # WPX45-2861), Raymond Powered Pallet truck (Serial # 102-07-07977), Toyota 5FBE18, and Toyota 2FBE18 forklift trucks to move pallets of materials throughout the buildings. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) through a certification that included the name of the operator, the date of the training, that date of evaluation, and the identity of the person(s) performing the training or evaluation: a) On or about 10/11/22, in Buildings 1 and 2; employees were exposed to struck by hazards when employer did not have written certifications for each Powered Industrial Vehicles(PIV)'s operator. Employees use PIVs such as, but not limited to; Clark WPX-45 pallet jack (Serial # WPX45-2861), Raymond Powered Pallet truck (Serial # 102-07-07977), Toyota 5FBE18, and Toyota 2FBE18 forklift trucks, for the purpose of moving materials throughout the facility. 29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) On or about 10/11/2022 throughout the establishment, employees were exposed to struck by hazards when the employer did not ensure employees with prior Powered Industrial Vehicle (PIV) experience were evaluated in the safe operation and working conditions of the workplace at least once every three years. Last evaluations expired on 2020 and March and November of 2021. Employees operate PIVs such as, but not limited to; Clark WPX-45 pallet jack (Serial # WPX45-2861), Raymond Powered Pallet truck (Serial # 102-07-07977), Toyota 5FBE18, and Toyota 2FBE18 forklift trucks to move materials throughout the facility.
