29 CFR 1910.106(e)(6)(ii): Category 2 flammable liquids must not be dispensed into containers unless the nozzle and container are electrically interconnected. On or about October 12, 2022, the employer failed to provide a way for employees to bond and ground the metal tank for the chemical product Velvacoat AL 7036 Coating IBC716 in the molding and mixing area when transferring the product from the tank to another container. Grounding the tank prevents static sparks from being generated which can ignite the liquid when it is transferring, exposing employees to a fire hazard.

29 CFR 1910.106(e)(2)(iv)(d): The employer did not have flammable liquids drawn from or transferred into vessels or containers, through a closed piping system, from safety cans, a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve. On or about October 12, 2022, the employer failed to develop a closed piping system that has approved self-closing valves when transferring flammable liquids from one container to the other through the means of gravity for the chemical product Velvacoat AL 7036 Coating IBC716 located in the molding and mixing area when transferring the liquids from the tank or barrel into a bucket or another container. Without the use of a self-closing valve, the flammable liquids can overflow and ignite if they get near a ignition source exposing employees to a fire hazard.

On or about October 12, 2022, the employer failed to provide additional exposure monitoring to employees exposed to respirable crystalline silica, or silica dust, in the Molding and Shakeout area after monitoring showed personal samples from employees were above the Action Level (AL) but still below the Permissible Exposure Limit (PEL) for silica dust exposures. The retest did not include the other Molding section or the Shakeout area where respirable silica dust was still at or above the AL exposing employees to respiratory illnesses without a way to monitor employees' exposure.

On or about October 12, 2022, the employer failed to provide additional exposure monitoring to employees exposed to respirable crystalline silica, or silica dust, in the Molding area after one non-initial test on September 7, 2018 showed the positions were below the Action Level (AL) for silica dust exposures. The employer discontinued exposure monitoring for respirable silica dust at or above the AL or PEL, which could expose employees to respiratory illnesses.
