OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the risk of caught-in hazards, point of operation hazards, and pinch-points while working on production machines. A. Lactalis Heritage Daily, Inc., Walton, NY: Employees were exposed to caught in hazards from the roller bar and lidder of Lidder Machine No. 1 when removing side guards to clear jams or lids that fail to seat properly. On or about October 6, 2022. Among other feasible means of abatement, the following means of abatement would eliminate or substantially reduce the hazard: 1. Instruct employees that they are not to remove machine guards to clear jams except in accordance with Lactalis' written Lockout/Tagout procedures; 2. Exercise reasonable diligence to ensure that above work rule is observed and enforce retraining and progressive discipline (when needed) in instances where infractions of said work rule are discovered.
