29 CFR 1910.136(a):General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet are exposed to electrical hazards: On or about October 12, 2022, the employer failed to implement and enforce the use of safety steel toe work shoes in the workplace for powered industrial vehicle operators who were exposed to struck by and caught in between hazards when moving and handling various loads of materials, to include but not limited to, large spools of paper product weighing approximately 2000 pounds or less per. -

29 CFR 1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: On or about October 12, 2022, the employer failed to ensure that employees who operate the various powered industrial vehicles, to include but not limited to, the Crown, Serial #9A220878, received full training for certification to safely operate a powered industrial vehicle. The employers training program consisted only of the hands on practical exercises and evaluation and did not include formal classroom training, a video or quiz.
