29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about October 8, 2022, employees were working within the structure of a RBI Pushback Racking System reconfiguring horizontal racking parts and supports without using fall protection. This exposed employees to a fall hazard of approximately 12 feet.

29 CFR 1910.30(c)(3): The employer did not retrain an employee when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee no longer had the requisite understanding or skill necessary to use equipment or perform the job safely. (a) On or about October 8, 2022 the employer did not ensure employees that were working within the structure of a RBI Pushback Racking System, reconfiguring horizontal racking parts and supports, recognized the approx. 12' fall hazard that the employees were exposed to.
