29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about November 3, 2022, the employer had not implemented the elements of an effective hearing conservation program while employees were exposed to noise above an 8-hour time-weighted average sound level of 85 dBA and above a dose of fifty percent. a) One employee, operating a chop saw, was exposed to noise levels at 278.2% of the allowable 8-hour time-weighted average sound level (85 dBA), which is equivalent to a 97.3 dBA noise level. b) One employee, operating a dismantler and pneumatic staple gun, was exposed to noise levels at 189.6% of the allowable 8-hour time-weighted average sound level (85 dBA), which is equivalent to a 94.6 dBA noise level. c) One employee, operating a chop saw, was exposed to noise levels at 264.8% of the allowable 8-hour time-weighted average sound level (85 dBA), which is equivalent to a 97.0 dBA noise level. d) One employee, operating a pneumatic staple gun, was exposed to noise levels at 91.9% of the allowable 8-hour time-weighted average sound level (85 dBA), which is equivalent to a 89.4 dBA noise level. HMM Pallets, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1600146, citation number 1, item number 1 and was affirmed as a final order on September 23, 2022, with respect to a workplace located at 20500 Stoney Island Ave., Lynwood, IL 60411.
