29 CFR 1926.502(b)(2)(i): Midrails, when used, were not installed at a height midway between the top edge of the guardrail system and the walking/working level: (a) Doris on Main Apartment Buildings, Wheeling, WV - On or about October 12, 2022, employees were performing framing and setting joists on the top of the 3rd story with an inadequate guardrail system installed at the sides and edges. There was a 38-inch gap between the midrail and the walking surface, exposing the employees to falls of approximately 30 feet to the ground.

The step ladder was positioned two feet below the topcap and joists exposing employees to a fall of at least 8 feet to the floor below.
