29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about October 14, 2022, the employer did not ensure that the competent person was conducting frequent and regular inspections of the job site to ensure fall protection was being worn, that fall protection systems were installed properly, that ladders were properly maintained, and job site conditions were maintained safe.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) On or about October 14, 2022, employees conducted roofing work on a flat commercial roof without the use of fall protection, exposing employees to a 16 foot fall hazard to the ground below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about October 14, 2022, employee(s) conducting roofing work while standing on the roof of the structure had not been trained to recognize the associated hazards and how to minimize or eliminate those hazards. This exposed employees to a fall of approximately 16 feet onto concrete.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about October 14, 2022, the portable articulating extension ladder being used to access the roof  of the structure did not extend at least three feet above the point of contact and landing surface. This exposed employees accessing and egressing the roof to a fall hazard of approximately 16 feet.
