OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a) Nixcavating, Inc, 3810 Spring Valley Rd, Boulder, CO 80304: On or about 10/14/2022, employees were exposed to struck-by and crushing hazards while unloading and transporting rebar that exceeded the dimensions of the for attachment on the loader that was used to complete the task. The forks were set to a max width of eight feet. The rebar was 40 feet in length. The load was not secure. During the task of moving the rebar bundle, if fell from the forks and struck a worker, resulting in a fractured bone.
