29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about October 13, 2022, employees in an excavation at 2226A Midland Boulevard were using one 10-foot section of a 20-foot extension ladder to enter and exit an excavation that was approximately nine feet deep. The ladder extended approximately six inches above the pavement.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. a) On or about October 13, 2022, employees in an excavation at 2226A Midland Boulevard were using one 10-foot section of a 20-foot extension ladder that had the top three inches (approximately)of the left side rail broken to enter and exit an excavation that was approximately nine feet deep. The broken part extended approximately three inches of the six inches that the side rail extended above the pavement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about October 13, 2022, employees in an excavation approximately 9-feet deep were not protected from cave-in hazards. GOODWIN & GOODWIN, INC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1405364, citation number 1 item number 3 and was affirmed as a final order on 04/13/2020, with respect to a workplace located at 4600 Newton Road, Fort Smith, Arkansas.
