29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a)Castro's Construction LLC at 5004 Anthony Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 17, 2022,  the employer did not ensure employees that were working from heights while engaged in roofing activities on a residential property were protected from falls using a fall protection system.  This condition exposed employees to fall hazards greater than six feet.  Castro's Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1433888, citation number 1, item number 2a, and was affirmed as a final order on December 18, 2019, with respect to a workplace located at 401 North Red Spruce Avenue, Sioux Falls, SD 57110.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Castro's Construction LLC at 5004 Anthony Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 17, 2022, the employer did not ensure that fall protection training was documented in a written certification prior to employees being exposed to fall hazards.  This condition exposed employees to fall hazards greater than six feet.
