The employer did not have a fork truck training and evaluation program so as to measure employee competency.

29 CFR 1910.178(m)(5)(i): The employer did not ensure that when a powered industrial truck is left unattended, load engaging means were fully lowered, controls were neutralized, power was shut off, and brakes set: a) On or about October 14, 2022, and at times prior, the employer, Pikes Peak Moving and Storage, LLC, did not protect employees from potential crushing or struck-by hazards when employees used powered industrial trucks to empty trash from moving crates filled with packing material to an approximate height of 8 feet, so as to remove material into roll-off dumpsters. When this process was performed, the powered industrial truck was left unattended and the load engaging means was not fully lowered.
