Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm. a) Dust collection system: On or about October 17, 2022, and at times prior to, employees were exposed to fire, explosion and deflagration hazards while conducting woodwork activities such as saw operations that generates combustible dust that accumulates inside portions of the building and is captured by a dust collection system that does not have safety systems such as deflagration panels.

29 CFR 1910.22(a)(1):29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a) Pre-Cut Building area: On or about October 17, 2022, and at times prior to, the employer exposed employees to fire and explosion hazardous conditions in that there was combustible saw dust accumulations on equipment and building structural supports ranging up to an 1 inch in depth.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a) Outside washing area: On or about October 17, 2022, and at times prior to, the employer exposed employees to corrosive chemical hazards by not ensuring a 380 gallon tote of sodium hypo chlorate that is used for washing pallets was labeled with identification of the hazard of the chemical and identification of the contents of a container.
