29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: Jobsite located at South Tyler Road North of Yosemite Street Wichita, Kansas by the City Cowskin Sanitary Lift/Pump Station, employees engaged in water/sewer line installation activities were exposed to cave in hazards or associated with collapse of trench walls. The competent person allowed employees to enter the unprotected trench which had water accumulation from the ground.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: At the jobsite located at South Tyler Road North of Yosemite Street Wichita, Kansas by the City Cowskin Sanitary Lift/Pump Station, employees engaged in water/sewer line installation activities were exposed to cave in hazards or associated with collapse of trench walls. Daily inspections of the trench site were not conducted as evidence of employees allowed to work inside the trench with water accumulation. Employees allowed to enter the unprotected trench approximately 14 feet deep without the proper configurations of the trench boxes, without the use of any adequate protective system. The site trench box was available and approximately 20 feet away but was not being utilized.

The competent person allowed employees to enter the unprotected trench approximately 14 feet deep without the proper configurations of the trench boxes, without the use of any adequate protective system.
