29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)M & M Roofing, LLC at 308 Spring Avenue North, Lake Preston, SD 57249: On or about and at times prior to October 19, 2022, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a single-family residence roof without the use of a fall protection system as well as ladder hazards identified on site.  This condition exposed employees to fall hazards of greater than six feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)M & M Roofing, LLC at 308 Spring Avenue North, Lake Preston, SD 57249: On or about and at times prior to October 19, 2022, the employer did not ensure that the ladder the employees were using was extended at least three feet above the upper landing surface of the eave of the single-family residential roof.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  (a) M & M Roofing, LLC at 308 Spring Avenue North, Lake Preston, SD 57249: On or about and at times prior to October 19, 2022, the employer did not ensure that employees were properly trained on the use of ladders or to recognize the hazards of using ladders prior to accessing upper areas of a single-family residential roof.  This condition exposed the employees to fall hazards greater than six feet.

29 CFR  1926.501(b)(13): Employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a)M & M Roofing, LLC at 308 Spring Avenue North, Lake Preston, SD 57249: On or about and at times prior to October 19, 2022, the employer did not ensure that employee were protected from falls while conducting roofing operations on a single-family residential roof. This condition exposed the employee to fall hazards greater than six feet.  M & M Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1551577, citation number 1, item number 1, and was affirmed as a final order on November 24, 2021, with respect to a workplace located at 2831 South Lancaster Drive, Sioux Falls, SD 57106.
