OSH Act of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by heavy equipment and trucks due to low visibility throughout the yard: a) At the trailer yard located at 1156 Old Norcross Road Lawrenceville, Georgia: On or about October 17, 2022, employees walked through and worked in areas where trailers are constantly moving, thereby exposing employees to struck-by and crushing hazards.

29 CFR 1910.178(n)(4): Industrial truck driver(s) were not required to slow down and sound the horn wherever vision was obstructed: (a) Throughout the facility, on or about October 19, 2022, and at times prior, the employer exposed workers to struck-by hazards where the use of horns on the powered industrial trucks was not enforced when entering/exiting trailers and operating in congested areas. Averitt Express, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178(n)(4), which was contained in OSHA inspection number 1368713, citation number 1, item number 2 and was affirmed as a final order on 5/23/2019, with respect to a workplace located at 4500 Birmingham Street Birmingham, Alabama 35217.
