29 CFR 1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. a. On or about and prior to October 20, 2022, the Galbreath H.D. 2200 Baler was not guarded with the electronic safety devices as provided by the manufacturer to protect the point of operation. The baler "door" interlock safety device was missing the "arm" component and did not function to protect the point of operation during the compaction cycle. Store employees operated the baler on a daily basis to process cardboard for disposal.

29 CFR 1910.147(c)(4)(ii):The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to items (a) through (d) of this section: a. On or about and prior to October 20, 2022, the employer failed to develop machine specific procedures for the Galbreath baler machine. Employees and contractors have potential exposure to crushing injury when performing activities, such as unjamming of bales in danger zone and machine repairs, such as interlock replacement.
