29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.  Don Mede L.L.C. dba Jose Israel Amaya Cruz located at 2595 Serenity Lake Lane, Building #14: On or about October 20, 2022, the employer failed to train employees on the hazards found on the worksite or the procedures to control or eliminate the hazards for employees prior to conducting residential construction related activities. The following condition exposed employees to electrical hazards and falls of over 20 feet.

29 CFR  1926.403(b)(1):Examination. The employer shall ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined on the basis of the following considerations:  29 CFR  1926.403(b)(1)(i): Suitability for installation and use in conformity with the provisions of this subpart. Suitability of equipment for an identified purpose may be evidenced by listing, labeling, or certification for that identified purpose.  a.  Don Mede L.L.C. dba Jose Israel Amaya Cruz located at 2595 Serenity Lake Lane, Building #14: On or about October 20, 2022, the employer did not ensure electrical equipment was free from recognized hazards. Employees used a portable flexible power cord  to supply power to portable electrical power tools. The power cable had a damaged strain relief device allowing internal cables to be visible and subject to damage.  The following condition exposed employees to electrical shock hazards.

Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a.  Don Mede L.L.C. dba Jose Israel Amaya Cruz located at 2595 Serenity Lake Lane, Building #14: On or about October 20, 2022, the employer did not ensure employees were protected from electrical contact hazards while engaged in residential construction activities. Employees used a portable flexible power cord  to supply power to portable electrical power tools. The power cable had a damaged strain relief device allowing internal cables to be visible and subject to damage.  The following condition exposed employees to electrical shock hazards.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Don Mede L.L.C. dba Jose Israel Amaya Cruz located at 2595 Serenity Lake Lane, Building #14:  On or about October 20, 2022, the employer failed to initiate and maintain safety/health programs such as but not limited to personal protective equipment, ladder safety, and fall protection/prevention prior to employees conducting residential construction activities. The following condition exposed employees to electrical shock hazards and falls of over 20 feet.  Don Mede L.L.C. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1518391, citation number 1, item number 1 and was affirmed as a final order on April 6, 2021, with respect to a workplace located at 1628 Ellary Ct., Delaware, Ohio 43015.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  On or about  October 20, 2022, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees conducted framing activities without being provided a fall protection/prevention system, thereby exposing them to fall hazards of over 20 feet.   Don Mede L.L.C. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1518391, citation number 1, item number 2 and was affirmed as a final order on April 6, 2021, with respect to a workplace located at 1628 Ellary Ct., Delaware, Ohio 43015.
