29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.  (a) Top of building "B" - On or about October 17, 2022, the employer did not ensure that employees framing the house, working at the edges that are greater than 6 feet high were protected from falling with the use of a fall protection system, exposing employees to fall hazards.

29 CFR  1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  EACH 1910 STANDARD USED MUST INCLUDE "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)" at the end of the SAVE.  (a) Throughout the work site - On or about October 17, 2022, the employer had an employee operate the all-terrain forklift without insuring he had been trained to operate the forklift safely exposing employees to struck by hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) South side of building - On or about October 17, 2022, the employer and employees use the 8' step ladder to gain access to the second-floor work are that did not extend 3 feet past the top edge exposing employees to fall hazards.
