OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards while operating a forklift without a seatbelt:   (a) Port Wentworth Apartments site: On or about October 21, 2022, the employer exposed employees to crushed-by hazards, in that an employee operated a forklift without a seatbelt.

29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a)  Leasing Building and Carriage House: On or about October 21, 2022, the employer exposed employees to flying object hazards, in that eye protection was not used while employees framed a building using nail guns and a circular saw.

29 CFR  1926.501(b)(1): "Unprotected sides and edges." An employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   (a)	Leasing Building: On or about October 21, 2022, the employer exposed employees to fall hazards, in that fall protection was not used while employees performed framing tasks approximately thirteen feet above concrete.
